A monthly meeting of the Town of Sheboygan Sanitary District No. 2 (Sewer) Commission began at 2:10 p.m. and a joint meeting of Sanitary District No. 2 (Sewer) and Sanitary District No. 3 (Water) Commissions began at 3:15 p.m. Sanitary District No. 3 (Water) continued on with their monthly meeting after the matters in Joint Session had been discussed on Tuesday, June 8, 2010 in open session at the Town of Sheboygan Town Hall, 1512 N. 40th St., Sheboygan, WI 53081, Sheboygan County. Notice of the meeting was given to the public at least 24 hours prior to the meeting by forwarding the complete agenda to the official Town newspaper, The Sheboygan Press, and to all news media who have requested the same, as well as posting in four (4) different places. Upon motions duly made and seconded, the following resolutions were unanimously adopted and made a part of these minutes by reference as if fully set forth herein.
1. Call to Order
The Sanitary District No. 2 (Sewer) monthly meeting was called to order by President Jeff Dedering at 2:10 p.m. Others present were J.D. Ison, Treasurer; David Griffin, Secretary and Kenneth Katte, Alternate. The following were also present at the meeting: Attorney Michael Bauer; Engineer Terry Johnson; Director of Public Works William Blashka; Supervisor Tod Holfeltz; Office Manager Darla Free and those persons on the attached list.
2. Approval of the June 8, 2010 Monthly Bills
“The Town of Sheboygan Sanitary District No. 2 (Sewer) Commission hereby approves the June 8, 2010 monthly bills as submitted per a motion by Commissioner Dedering and a second by Commissioner Ison.” Motion carried.
3. Sewer Odor Issue-N 43rd St
Lori Rivest, 1443 N 43rd St, is not able to attend today’s meeting, nor has she contacted with DPW Blashka with an update. Supervisor Holfeltz continues to add chemicals twice a week to the CTH Y lift station, Tuesdays and Thursdays. The Commissioners request that the chemicals continue to be added twice a week. An update will be given at next month’s meeting.
4. Review/Approval – 2009 Compliance Maintenance Annual Report
DPW Blashka reports that the District system didn’t have any problems that were required to be reported in 2009. There weren’t any backup incidents. The CTH Y lift station did have a failure, but it didn’t result in a by-pass situation. The SCADA System upgrade to the lift stations has been included in the report. The District’s sewer rate charges are reviewed during the audit. The District’s equipment replacement fund activity is a combination of the Heartland Business Bank operational/replacement fund and two cd accounts at Community Bank. The District’s capacity is in the report, which is provided by Engineer Johnson. The District will be required to create and implement a CMOM manual. This manual will be an overview of the municipal system for public record that DPW Blashka will be completing. Commissioner Griffin advises DPW Blashka to add the internal seals project to next year’s CMAR Report, relating to I&I controls. “The Town of Sheboygan Sanitary District No. 2 Sewer Commission hereby approves Resolution 1-2010 Town of Sheboygan Sanitary District No. 2 Sewer Wisconsin Department of Natural Resources NR 208 - Compliance Maintenance Resolution 2009 as submitted per a motion by Commissioner Dedering and a second by Commissioner Ison.” Motion carried.
5. Review/Approval – Ordinance Repealing and Recreating Section 7.022 of the Town of Sheboygan Sanitary District No. 2 Sewer Use and Sewer Service Charge Ordinance
The City of Sheboygan has raised their 2010 quarterly wastewater treatment charges from $58.51 to $59.42. “The Town of Sheboygan Sanitary District No. 2 Sewer Commission hereby adopts Ordinance No. 1-2010, an Ordinance Repealing and Recreating Section 7.022 of the Town of Sheboygan Sanitary District No. 2 Sewer Use and Sewer Service Charge Ordinance per a motion by Commissioner Griffin and a second by Commissioner Ison.” Motion carried.
6. Interest Rate Update for District Investments
The Community Bank Investor’s Choice money market interest rate is currently at 1.0%. The District’s Replacement/ Operational money market at Heartland Business Bank is at 1.20%. CD rates are between .75% (4-mos.) and 1.50% (17-mos.). Attorney Bauer provides the State statute that regulates how the District’s funds can be invested. The Commissioners will keep all funds in their current accounts and review investment options, CD and money market rates at next month’s meeting.
7. SCADA System Update for Lift Stations
Nothing submitted, no updates. This item will remain on the agenda.
8. UCE Formula Update
If a land use change or if an additional structure or a material expansion of an existing structure results in a material change in the quantity or quality of wastewater being discharged, the ordinance change allows for an additional connection fee to be calculated pursuant to the District’s UCE formulas and an additional connection fee may be assessed. “The Town of Sheboygan Sanitary District No. 2 Sewer Commission hereby approves an Ordinance Amending Section 6.03 of the Town of Sheboygan Sanitary District No. 2 Sewer Use and Sewer Service Charge Ordinance per a motion by Commissioner Dedering and a second by Commissioner Ison.” Motion carried.
9. Internal Seals
DPW Blashka states that the first phase of this project is now complete for the year. Within two months he will submit a list for another 30-40 manholes to have seals installed for spring, 2011. Parts will be ordered at the end of this year. The manholes that will be affected by the Mueller Rd. project will have internal seals installed by whoever is awarded the bid. The Mueller Rd. manholes currently do not have internal seals. Bidding for this project was yesterday. Commissioner Dedering directs DPW Blashka to contact the contractor who gets awarded the project to see if they’ll install the internal seals in the Mueller Rd. manholes and invoice the District for expenses incurred.
10. Operator’s Report
The CTH J lift station lost vacuum pressure. There was a pump failure. The notification light lit but wouldn’t dial out. After checking the dials, it seemed fine. The CTH J lift station has two different size vacuum pumps. There is a large spare pump in stock, but not a small spare pump. The Sheboygan County Highway Department was contracted to grind down the asphalt around the manholes on Wild Meadow Dr. Wild Meadow Dr. is the main road running through Green Meadow Subdivision. All of the castings have been lowered. The Town will be paying for this project. The final top coat of asphalt hasn’t been installed due to slow development. Wild Meadow Dr. is beginning to deteriorate because the final asphalt hasn’t been laid and the manholes are at final elevation. Blacktop was added around the manholes for plowing, creating a bump. Traffic steers around the manholes, causing the edge of the road to deteriorate. The residents on Green Meadow Pl. and Wild Meadow Ct. are now requesting to have the asphalt ground down around the manholes on their streets. Windward Ct. is being repaved and there will be manhole adjustments made. The Town will be paying for this project. DPW Blashka will submit, via e-mail, an electronic copy of the 2010 Sewer User Charge Survey. DPW Blashka reports that the spikes in the May flows were due to precipitation.

Sanitary District No. 2 (Sewer) and Sanitary District No. 3 (Water) 3:15 P.M. Joint Agenda
12. Call to Order, Joint Meeting - Sanitary District No. 3 (Water)
“The Town of Sheboygan Sanitary District No. 3 (Water) Commission hereby makes a motion to call the joint meeting to order at 3:15 p.m. per a motion by Commissioner Flasher and a second by Commissioner Hoeppner.” Motion carried. Commissioner Lutzke is also in attendance.
13. Approval of the May 11, 2010 Monthly Meeting Minutes
“The Town of Sheboygan Sanitary District No. 2 (Sewer) Commission hereby approves the May 11, 2010 meeting minutes per a motion by Commissioner Dedering and a second by Commissioner Ison.” Motion carried. “The Town of Sheboygan Sanitary District No. 3 (Water) Commission hereby approves the May 11, 2010 meeting minutes per a motion by Commissioner Flasher and a second by Commissioner Hoeppner.” Motion carried.
14. Projects
A. Paul Bulitz, N6327 Rangeline Rd./Water and Sewer Extension
Mr. Bulitz has received all necessary approvals to move forward with this project. There has been no further contact by Mr. Bulitz or his engineer, Warren Vandoske. A pre-con will be required before construction can begin.
B. Fifth Generation Properties LLC/High Tech Ln Project
An 8” main will be brought into the building. There is a hydrant that needs to be re-located for driveway access. This will be coordinated with DPW Blashka and the contractor.
C. Wal Mart As-builts Update
A letter was drafted but not sent, giving Wal Mart until July 1, 2010 to have all as-builts submitted to the Districts or the Districts would begin the project and invoice Wal Mart for all costs incurred. Instead, DPW Blashka will make contact via e-mail to find out the status of receiving the Wal Mart as-builts.
15. 5027 Lakeshore Rd Update – Temporary Placement of Mobile Home Due to Fire
Due to a house fire at 5027 Lakeshore Rd., a mobile home has been placed on the lot until construction of a new home is complete. The trailer has been connected to municipal sewer and water. There is a grinder pumping running above ground, into the sewer clean-out. The lateral has been capped to prevent infiltration. The water is being served through a poly line. Construction of the new home hasn’t begun because there hasn’t been a release from the fire department due to the ongoing investigation. The homeowners are allotted 120 days to have the trailer onsite. They may require an extension from Sheboygan County to keep the trailer on-site until construction is complete.
16. Town of Sheboygan Plan Commission Update
Commissioner Hoeppner states that the Plan Commission has made a recommendation to the Town Board to approve the Ordinance Amendment to Section 4.1 District Regulations and Section 5.15 Wellhead Protection Ordinance of the Zoning Code of the Town of Sheboygan with the changes adding the word Zone after District. This matter will be discussed further under line item 25 of this agenda.
17. Pending Item List Review
The pending item list is reviewed and updated accordingly. The list is part of the minute book for review and record purposes.
18. Operator’s Report
There will be a section where manholes and main have to be re-located due the Sheboygan County Highway CTH O project. The Town utility crew can raise hydrants and move valve boxes, but can’t do barrel sections. “The Town of Sheboygan Sanitary District No. 2 Sewer Commission hereby directs DPW Blashka to contact Larry’s Sewer and Water to make the necessary adjustments along CTH O, between N 45th St. and Woodland Rd., per a motion by Commissioner Dedering and a second by Commissioner Ison.” Motion carried. “The Town of Sheboygan Sanitary District No. 3 Water Commission hereby directs DPW Blashka to contact Larry’s Sewer and Water to make the necessary adjustments along CTH O, between N 45th St. and Woodland Rd., per a motion by Commissioner Flasher and a second by Commissioner Lutzke.” Motion carried.
19. Communication & Correspondence Received After Posting of Agenda
The Commissioners review and acknowledge receipt of the Heartland Business Bank Electronic Check Processing Agreement. There are no fees to be charged for the program and module. This item will be on the Town Board’s June 15, 2010 agenda for further discussion and review.

21. Approval of the June 8, 2010 Monthly Bills
“The Town of Sheboygan Sanitary District No. 3 (Water) Commission hereby approves the June 8, 2010 monthly bills as submitted per a motion by Commissioner Flasher and a second by Commissioner Lutzke.” Motion carried.
22. Lateral Leak Reimbursement – N6455 Abbey Ct
Chad Black was in attendance for this agenda item. He was the property owner of N6455 Abbey Ct. from May 27, 2003 through July 20, 2006. He had a lateral leak in April of 2006. The leak was located between the main and the curb stop. He incurred the total cost of $1,093.40, which was dictated by District ordinance. Mr. Black stated that he did not submit an insurance claim to his insurance provider. The ordinance was reviewed and amended on Sept. 8, 2009 to read that the District shall be responsible for the maintenance of the service lateral from the main to and through the curb stop. The property owner shall maintain the service lateral from the curb stop to the point of use within the building. Commissioner Flasher asks Mr. Black if he recovered this expense through the sale of his home. Mr. Black stated that he did not, that he felt the leak was a disadvantage when he sold his home because the leak occurred when the house went on the market and any potential buyers knew of the situation. “The Town of Sheboygan Sanitary District No. 3 (Water) Commission hereby approves reimbursing Chad Black $1,093.40 for lateral repairs per a motion by Commissioner Flasher and a second by Commissioner Hoeppner.” Motion carried.
23. Water Service to 5300 Hwy 42 N/Craig Franzen
Mr. Franzen was contacted via e-mail and letter on May 25, 2010 and also e-mailed on June 8, 2010 requesting an update on his water extension request. Mr. Franzen had previously stated that he is waiting for approval of financing from his bank. Due to the end-of-the-year deadline imposed by the DNR for this extension, the District has informed Mr. Franzen of their concerns in the ability to complete the project on time if it doesn’t begin within the next few weeks. Mr. Franzen has not replied to any of the District’s correspondence at this time. This item will remain on the agenda.
24. Tower 1 – Bids for Repair
Tower 1 is in need of spot repair due to rusting. Water Tower Clean and Coat, Lodi, WI, submitted a bid of $3,200; Lane Tank, Mosinee, WI, submitted a bid of $4,300; Aero Painting, Elkhart Lake, WI submitted a bid of $4,888. LC United did the original painting of Tower 1. Aero Painting is based out of Elkhart Lake. Lane Tank out fit this project into their schedule. DPW Blashka makes a recommendation to the Commission to hire Lane Tank to do the repairs. Because this is a repair, this project does not have to be bid out. DPW Blashka will contact Dixon Engineering to check on any tower work that Lane Tank has done. “The Town of Sheboygan Sanitary District No. 3 (Water) Commission hereby directs DPW Blashka to check with Dixon Engineering of any problems with Lane Tank for the paint repairs of Tower 1 and to hire the recommended contractor at a cost not to exceed $4,300 per a motion by Commissioner Flasher and a second by Commissioner Lutzke.” Motion carried.
25. Well 3 and Wellhead Protection Update
On June 1, 2010 the Plan Commission has made a recommendation to the Town Board to approve the Ordinance Amendment to Section 4.1 District Regulations and Section 5.15 Wellhead Protection Ordinance of the Zoning Code of the Town of Sheboygan with the changes adding the word Zone after District. The ordinance will be adopted by the Town Board on June 15, 2010. One condition of the ordinance dictates that animal fertilizer cannot be spread within 1,000 ft. of the District’s wells. Office Manager Free will send a letter of explanation and a copy of the ordinance to anyone within 1,000 ft. of Well 3, which this ordinance may impact. Commissioner Flasher will contact Town of Mosel President Dirk Zylman and see if they will support the ordinance.
26. Operator’s Report
The utility crew has been flushing hydrants and mains. The chlorination of the system has now been set since the switch was made from chlorine gas to tablets. By eliminating the chlorine gas, the crew no longer is required to be trained in many areas and less maintenance is required. The cost of the tablets is higher than the gas, but reporting and training is less. The leaks that were located and repaired at the property that that had the fire, 5027 Lakeshore Rd., were on both sides of the curb stop. Larry’s Sewer and Water made the repairs. A new poly line was pulled under Lakeshore Rd. The line was difficult to pull because it had multiple connectors. The original line was installed by Dorner Stahl. The leak was located in the middle of the driveway. The District will be responsible for the driveway repair. DPW Blashka will contact Northeast Asphalt for a quote to do the repair after the new home construction is complete. David Streblow, resident of 2036 Waverly Ct., contacted the emergency pager on June 5, 2010 because he had water coming out of the ground on his property. DPW Blashka located a lateral leak and informed the residents that it would be repaired on Monday. The leak was located between the main and the curb stop. Due to the rain and the ground water, the repair was scheduled to be done on June 9. DPW Blashka will send a letter to all Maple Forest residents, explaining the leak location investigation that was done by the himself and the utility crew, informing them that the only leak found and repaired was at W1998 W North Ave., and that no further leak investigation is planned in that subdivision at this time.
27. Communication & Correspondence Received After Posting of Agenda
The Town Board advised Sanitary District No. 3 (Water) Commission to review their policy regarding charging the City of Sheboygan for use of the District’s fire hydrants. The City of Sheboygan’s past policy was to bill the Town of Sheboygan $60 per quarter a hydrant rental fee. They have since decided to charge a fee of $50 hydrant charge plus gallons used only if the Town connects to a City hydrant. The District’s policy, dictated by the PSC, allows for a $10 hydrant charge plus gallons used. A full rate case study would be required if the District would want to increase this rate.
